How Does Family Dispute Resolution Work?
The Family Dispute Resolution (FDR) process begins with an initial assessment to determine whether mediation is suitable for the parties involved. This assessment considers the nature of the dispute, any safety concerns, and the willingness of both parties to participate constructively. If mediation is appropriate, a trained and neutral Family Dispute Resolution Practitioner (FDRP) facilitates the sessions, ensuring fairness and impartiality throughout the process. The mediator encourages open and respectful communication, creating a safe environment where each party can express their concerns, emotions, and perspectives without judgment. During these discussions, the key issues underlying the dispute, such as parenting arrangements, financial matters, property division, or communication difficulties, are clearly identified and explored.
As mediation progresses, the parties are guided to explore options and brainstorm practical solutions. This stage focuses on negotiation, compromise, and finding common ground, with particular attention given to the best interests of any children involved and the need for long-term cooperation and stability. The FDRP supports the parties in reaching mutually acceptable agreements that address their needs and priorities. Parties may seek independent legal advice before finalizing the terms, after which the agreed outcomes are implemented according to the specified timeline and procedures.
